Lawsuit of the Day: Filmmakers Say “Happy Birthday” is in Public Domain, Sues Warner for Collecting Royalties

For more than two decades, filmmakers and video producers have paid Warner/Chappell Music licensing fees to use the “Happy Birthday” song. And for many years, the American music publishing company has claimed that the intellectual property rights to the song will remain privately owned until 2030—but maybe not for long. The filmmakers behind an upcoming documentary, tentatively titled “Happy Birthday,” has filed a lawsuit against Warner/Chappell with a huge body of evidence supporting that the the song has actually been in the public domain since the 1920s. If ruled in their favor, the music may have to return the hundreds of millions they’ve improperly charged in licensing fees since.

“Sociologists who have stopped the time-machine and, with a good deal of conceptual huffing and puffing, have gone down to the engine room to look, tell us that nowhere at all have they been able to locate and classify a class. They can only find a multitude of people with different occupations, incomes, status-hierarchies, and the rest. Of course they are right, since class is not this or that part of the machine, but the way the machine works once it is set in motion – not this and that interest, but the friction of interests – the movement itself, the heat, the thundering noise. Class is a social and cultural formation (often finding institutional expression) which cannot be defined abstractly, or in isolation, but only in terms of relationship with other classes; and, ultimately, the definition can only be made in the medium of time - that is, action and reaction, change and conflict. When we speak of a class we are thinking of a very loosely defined body of people who share the same congeries of interests, social experiences, traditions and value-system, who have a disposition to behave as a class, to define themselves in their actions and in their consciousness in relation to other groups of people in class ways. But class itself is not a thing, it is a happening.”

“In short, to anyone with dating experience, “nice guy” sounds like “essentially lackluster, if largely unobjectionable male person.” And this is what you’re presenting as your best trait. This is what you aspire to. Now, I hear some of you complaining “women always say they want a nice guy.” I know lots of women — I’m even related to a few — and I can’t say I’ve ever heard any of them say that. I can’t prove it, but this sounds like one of those things stand-up comedians say about women and everyone else just repeats. I’ve also never known a woman who cries when she breaks a nail — although I’ve known a few who swear like a 15-year-old sailor in jail — and I’ve never had a woman ask me if her outfit made her look fat unless she actually wanted and subsequently appreciated my opinion. So either I’ve stumbled upon a secret trove of women who aren’t passive-aggressive sob machines, or you need to stop mistaking Dane Cook routines for peer-reviewed sociological studies. At any rate, if a woman does say “I just wish I could find a nice guy,” I would suggest this is the equivalent of “I’m so hungry I could eat a horse.” Which is to say, she’s not hoping you’ll say, “You’re in luck, I have a dead horse in my backyard!” The Sapir-Whorf hypothesis states that the way you use language shapes your perception of the world. (This should not be confused with the Sapir-Worf hypothesis, which states that the Romulans are lying and we should raise shields.) So maybe you’d become a better person if you started by not using such a flaccid, pallid term to refer to yourself. Here’s my suggestion: Instead of trying to be a nice guy, aspire to be a good man. You might be surprised at the results.”

If grandmothers around the world had a rallying cry, it would probably sound something like “You need to eat!”

Photographer Gabriele Galimberti’s grandmother said something similar to him before one of his many globetrotting work trips. To ensure he had at least one good meal, she prepared for him a dish of ravioli before he departed on one of his adventures.

“In that occasion I said to my grandma ‘You know, Grandma, there are many other grandmas around the world and most of them are really good cooks,” Galimberti wrote via email. “I’m going to meet them and ask them to cook for me so I can show you that you don’t have to be worried for me and the food that I will eat!’ This is the way my project was born!”

The project, “Delicatessen With Love”, took Galimberti to 58 countries where he photographed grandmothers with both the ingredients and finished signature dishes.

Galimberti said many of the subjects for the project were selected serendipitously, picked while he was working on a project about couch surfing that explored the global phenomenon of staying in other people’s houses. Since Galimberti never slept in hotels while working on the project, he was able to come into contact with people who introduced him to grandmothers in the area.

Galimberti acted as photographer and stylist during each shoot with the grandmothers, taking a portrait of both the women and the food they made for him.
